Baby Track Pro – Terms of Use

Welcome to Baby Track Pro.

By downloading, installing, accessing, or using the Baby Track Pro mobile application, website, or related services (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the Services.

1. Description of Services

Baby Track Pro is a personal tracking and journaling application designed to help caregivers record and review baby- or toddler-related activities, including but not limited to feeding, sleep, diaper changes, medicine logs, growth entries, reading, tummy time, bath, spit-up, and other caregiver-entered information.

Information you enter may be stored locally on your device, including: baby name, birth date, photos; parent name, email; activity data (feeding, diaper, sleep, etc.); and voluntary health-related data (e.g. non-medicine growth data). The Services may present summaries, trends, reminders, estimates, or insights derived from user-provided data. These outputs are general, informational, and non-authoritative and are provided solely for personal reference and convenience.

Baby Track Pro does not monitor your child in real time, does not guarantee accuracy, and does not replace caregiver judgment, supervision, or responsibility.

2. No Medical, Health, or Professional Advice

Baby Track Pro:

• Is not a medical device
• Is not regulated as a medical product
• Does not provide medical, diagnostic, therapeutic, or treatment advice

All information, summaries, insights, estimates, reminders, or patterns displayed in the Services:

• Are not medical advice
• Are not health recommendations
• Are not instructions or guarantees
• Must not be relied upon for safety-critical or health-related decisions

You acknowledge and agree that:

• You are solely responsible for your child’s care, supervision, and well-being
• You must consult a qualified healthcare professional for medical questions or concerns
• In the event of an emergency, you should contact emergency services immediately

3. Assumption of Risk

You expressly acknowledge and agree that:

• Caring for infants and children involves inherent and unpredictable risks
• Any reliance on information, reminders, estimates, or insights provided by the Services is entirely at your own risk
• The Services may contain errors, omissions, delays, inaccuracies, or incomplete information

You voluntarily assume all risks arising from your use of the Services, including risks related to sleep, feeding, health observations, missed cues, caregiver decisions, or third-party actions.

4. Eligibility and Account Responsibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities conducted through your account
• The accuracy, completeness, and appropriateness of information you enter

Baby Track Pro is not responsible for unauthorized access resulting from your actions or omissions.

5. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes
• Attempt to gain unauthorized access to systems or data
• Reverse engineer, decompile, or tamper with the Services except where legally permitted
• Use the Services in any manner that could cause harm, disruption, or legal exposure

6. Subscriptions and Payments

Certain features may require a paid subscription. The monthly premium is USD $9.99 per month, and the yearly premium is USD $99.99 per year (or local equivalent). Premium features include:

• Sleep Predict & Insights — Nap windows, sleep pattern analysis, and optimal sleep insights
• Bottle Guidance — Next bottle prediction and feeding reminders
• Smart Reminder — Reading, tummy time, sunlight & feeding reminders
• Advanced Data Export — Export your data for backup & analysis

By subscribing, you agree that your subscription will automatically renew on a monthly or annual basis (depending on the plan you choose) until you cancel. You will be charged for each renewal period at the then-current rate. You may cancel at any time before the next billing date to avoid being charged for the following period; cancellation is managed through your device or app store account.

Billing cycles, renewal terms, and cancellation options are disclosed at the time of purchase. Refunds, if any, are governed solely by the policies of the applicable app store (Apple App Store or Google Play).

7. Intellectual Property

All rights, title, and interest in the Services, including software, content, design, logos, and branding, are owned by Baby Track Pro or its licensors.

You are granted a limited, non-exclusive, revocable license to use the Services for personal, non-commercial purposes only.

8. Privacy

Your use of the Services is governed by our Privacy Policy.

You acknowledge that:

• No system is completely secure
• We cannot guarantee absolute protection of user data

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

To the maximum extent permitted by law, Baby Track Pro disclaims all warranties, express or implied, including but not limited to warranties of:

• Accuracy
• Reliability
• Availability
• Fitness for a particular purpose
• Error-free operation

We do not warrant that the Services will meet your expectations, be uninterrupted, or prevent any harm or adverse outcome.

10. Limitation of Liability

To the maximum extent permitted by law, Baby Track Pro and its affiliates, founders, officers, employees, contractors, and agents shall not be liable for any:

• Personal injury or health outcomes
• Child-care-related decisions or reliance
• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, goodwill, or business interruption

Total aggregate liability shall not exceed the greater of:

• The amount paid by you in the twelve (12) months preceding the claim, or
• USD $10

Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Baby Track Pro and its affiliates from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising from:

• Your use or misuse of the Services
• Your reliance on any information provided
• Your violation of these Terms
• Any child-care decisions made by you or third parties

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice or cause.

Upon termination:

• Your right to use the Services immediately ceases
• Provisions relating to disclaimers, limitation of liability, indemnification, and governing law survive

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.
